Terms of Sale

These Terms of Sale ("Terms") govern use of the Phoenix Flowers website and requests for bouquets, floral arrangements, delivery, and related services. "Phoenix Flowers," "we," "us," and "our" refer to Phoenix Flowers in Phoenix, Arizona. By submitting an order request, you agree to these Terms and confirm that you are at least 18 years old and legally able to enter into a contract.

1. Website information and availability

Product photographs and descriptions are illustrative. Flowers are natural and seasonal, so color, size, variety, wrapping, and arrangement may vary. We may correct errors, update the catalog, limit quantities, or withdraw a product or promotion at any time. Website availability is not a guarantee that a particular flower or delivery window remains available.

2. Order requests and acceptance

Submitting a form or adding an item to the cart sends us a request; it does not by itself create an accepted order. We will contact you to confirm availability, substitutions, the final price, taxes and fees, delivery details, and payment method. A binding order is formed only when both you and Phoenix Flowers confirm those material details. Please review your confirmation promptly and tell us about errors.

3. Prices, taxes, and payment

Website prices are displayed in U.S. dollars. Applicable sales tax, delivery charges, rush fees, and other disclosed charges may be added to the confirmed total. If a custom design or substitution changes the price, we will ask for your approval before confirming the order.

The website does not currently collect online payment. Available payment methods are shown in the request form or offered when we confirm an order. Payment timing and instructions become part of the confirmed order. You represent that you are authorized to use the selected payment method.

4. Substitutions and custom designs

Because flower supply changes daily, an exact variety, shade, or container may be unavailable. We may propose a substitution of comparable style and value. Material changes require your approval before the order is confirmed. For florist's-choice or bouquet-of-the-day products, you authorize reasonable creative substitutions consistent with the agreed style, size, and value.

5. Delivery

Delivery is offered within the confirmed Phoenix, Arizona service area. Delivery windows are estimates unless we expressly agree to a guaranteed time. You are responsible for providing a complete, accurate address, ZIP code, recipient information, access instructions, and a reachable phone number.

If the recipient is unavailable, we may follow the delivery instructions, leave the order in a reasonably safe location, contact you or the recipient, or return the order, as circumstances permit. Redelivery or address-correction charges may apply when a delivery fails because information or access supplied by the customer was incomplete or inaccurate. Risk of loss passes when the order is delivered to the recipient, an authorized person, or the agreed safe location.

6. Changes, cancellation, and refunds

Contact us as soon as possible to request a change or cancellation. We will provide a full refund for an accepted cancellation made before we begin design work or purchase materials specifically for the order. Once custom work or procurement has begun, we may deduct reasonable, nonrecoverable costs; once an order has been completed or dispatched, perishable or custom goods generally cannot be returned for a change of mind.

If an order arrives damaged, materially defective, or materially different from the confirmed order, contact us on the delivery date and provide a photo when reasonably possible. Depending on the circumstances, we may replace the affected item, correct the order, issue a partial or full refund, or provide another appropriate remedy. Nothing in these Terms limits any nonwaivable consumer right or remedy.

7. Promotions

Promotions are subject to their stated dates, thresholds, exclusions, and availability. Unless a promotion expressly says otherwise, offers cannot be combined, have no cash value, and apply before tax and delivery charges. We may refuse a promotion obtained through error, fraud, or misuse, subject to applicable law.

8. Customer-provided content and third-party information

You are responsible for having permission to provide a recipient's contact and delivery information and for the content of card messages or instructions. Do not submit unlawful, infringing, threatening, discriminatory, or harmful content. You authorize us and our fulfillment providers to use submitted information only as reasonably necessary to process and deliver the order and as described in our Privacy Policy.

9. Intellectual property and acceptable use

The website's design, text, graphics, photographs, logos, and other content are owned by Phoenix Flowers or used with permission and are protected by applicable law. You may use the website for personal shopping and legitimate business inquiries. You may not interfere with the website, attempt unauthorized access, scrape it in a manner that burdens the service, introduce malicious code, or use its content commercially without permission.

10. Disclaimers and limitation of liability

To the fullest extent permitted by law, the website is provided "as is" and "as available." We do not warrant uninterrupted or error-free access. To the fullest extent permitted by law, Phoenix Flowers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use or an order. Our aggregate liability arising from a particular order will not exceed the amount paid for that order. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.

11. Events beyond reasonable control

We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, road closures, natural disasters, utility or network outages, labor disruptions, government action, or supplier failures. We will make reasonable efforts to notify you and offer an appropriate alternative where practicable.

12. Governing law and disputes

Arizona law governs these Terms, without regard to conflict-of-law rules. Courts located in Maricopa County, Arizona will have jurisdiction over disputes, except where applicable consumer law gives you the right to bring a claim elsewhere. Before filing a claim, the parties should attempt in good faith to resolve the issue directly. Nothing in this section waives rights that cannot legally be waived.

13. Electronic communications

You consent to receive order-related communications electronically or by phone using the details you provide. Electronic records and confirmations may be retained. Marketing messages, if ever offered, require any consent required by law and are not a condition of purchase.

14. Changes and severability

We may update these Terms prospectively by posting a revised version and effective date. The Terms in effect when an order is confirmed govern that order unless you and Phoenix Flowers agree otherwise. If any provision is unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver.
